Amberstill — Terms of Service

Version 1.0 — Effective: October 28, 2026

These Terms govern your use of Amberstill (formerly The Usual) (the "App"), at trytheusual.com and any other address we use for it, operated by Addletic, LLC ("we," "us"). Contact: support@amberstill.app, 144 Village Landing #349, Fairport, New York 14450-1804, United States.

1. Eligibility — 21+ only

You must be at least 21 years old (the U.S. legal drinking age) to use the App. By using it you confirm you are 21+. We block access to anyone who indicates they are under 21 and will delete accounts we learn belong to someone under 21.

2. Invite-only pilot / beta

The App is an invite-only pilot, starting Tuesday, October 27, 2026, 8:00 PM PT. It is free; there are no payments. Features may change, break, or be removed, and data may be reset with notice where practical. The pilot may end at any time. Feedback you give us may be used without obligation to you.

3. Accounts

Sign in with your email and a password, or with Google. You're responsible for activity on your account. Keep your email account secure.

4. What the App does

• Ratings (Like / Pass / Haven't tried), taste sliders, and "where/who made it" tags.
• Your Cellar of drinks.
• AI menu reading: you upload a menu photo or text; it is sent to Anthropic to produce a drink list. Menu photos are re-encoded on your device, which removes location metadata (EXIF/GPS). Avatars may currently keep embedded location data, so use a photo without it (see Privacy Policy). Please avoid photographing people. We don't perform facial recognition.
• Personalized similar-drink predictions (when released), generated by our own taste model, trained on users' ratings and likes, not by third-party AI. We never sell your data and don't use it to train third-party AI models.
• Taste Card QR code you can choose to show a bartender. Card links contain only the taste info shown on the card and no account info. Shared links can't be revoked individually and keep working after account deletion.
• Later, optionally: coarse location for weather-based suggestions; nearby venue info from Google Places.

5. Responsible drinking

The App is for discovery and enjoyment, not encouragement to drink. Drink responsibly and within the law. Never drink and drive. Do not drink if pregnant, taking medications that interact with alcohol, or otherwise advised not to. Suggestions are not a recommendation to consume any quantity of alcohol. Bartenders and venues decide what they serve and must check ID independently; a Taste Card is not proof of age.

6. AI and prediction disclaimers

Menu reading and predictions are generated automatically, including by third-party AI (Anthropic). Output may be wrong or incomplete — names, ingredients, prices, allergens, and alcohol content may be misread. Do not rely on the App for allergen, dietary, medical, or alcohol-content information; ask the venue. Predictions are guesses, not guarantees. AI-read menus are labeled: "Read by AI. May contain errors. Confirm allergens, prices, and alcohol content with your server."

7. Your content

You keep ownership of what you submit (ratings, notes, recipes, photos). You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display it to operate and improve the App, including sending menu images to our AI processor. Your recipes are private to you. Menu photos are never stored. Drinks you save from a menu are always public, and show the venue (name and city) and the dates it was seen on a menu. We don't show your username on menu drinks. Drinks saved from a menu can't be made private. To have one removed, email support@amberstill.app and we'll delete it within 30 days. For public drinks, including drinks saved from menus, the license above is perpetual and survives account deletion: unless you remove them (including via the "Also delete my public drinks" option at deletion), they may remain in the App, shown without your name or avatar (see Privacy Policy §7). Only upload menus/photos you have the right to use; don't upload photos of people without consent.

8. Third-party content and services

Drinks from books or websites (including Liquor.com) are shown publicly by name and source/link only. Their recipes and ingredients are private to the user who saved them and are used only to find similar drinks. Links to third-party sites (e.g., Liquor.com) are provided for convenience; we don't control or endorse them. Weather data by Open-Meteo.com (CC BY 4.0). Place information © Google Maps, subject to Google's Terms (https://maps.google.com/help/terms_maps/) and Privacy Policy (https://policies.google.com/privacy). Google sign-in is subject to Google's terms.

9. Acceptable use

No unlawful use, harassment, scraping, reverse engineering, abuse of the AI feature, circumventing the age gate, uploading malware or infringing/obscene content, or using the App to facilitate sales of alcohol or service to minors or intoxicated persons.

10. Termination

You can delete your account at any time (by emailing support@amberstill.app during the pilot; in-app deletion is planned); what happens to your data is described in Privacy Policy §7. We may suspend or terminate access, especially for under-21 users or misuse.

11. Disclaimers

THE APP IS A PILOT PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY HARM FROM ALCOHOL CONSUMPTION, AND OUR TOTAL LIABILITY IS LIMITED TO US$100. Some jurisdictions don't allow these limits.

13. Indemnity

You'll indemnify us for claims arising from your content or your violation of these Terms or law.

14. Governing law and disputes

Governed by the laws of New York, excluding conflict rules. Any dispute will be resolved exclusively in the state or federal courts located in Monroe County, New York, and you and we consent to their jurisdiction. There is no arbitration agreement or class-action waiver in these Terms.

15. Copyright complaints (DMCA)

If you believe content in the App infringes your copyright, send a notice to our designated agent: Addletic, LLC, Attn: Copyright Agent, 144 Village Landing #349, Fairport, New York 14450-1804, phone 585-205-8811, copyright@amberstill.app (U.S. Copyright Office registration DMCA-1083811), including the elements required by 17 U.S.C. §512(c)(3). We may remove content and terminate repeat infringers. Counter-notices may be sent to the same address.

16. Electronic notices

You consent to receive notices, agreements, and other communications electronically (in-app or by email), which satisfy any writing requirement.

17. General

These Terms and the Privacy Policy are the entire agreement between you and us about the App. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.

18. Changes

We may update these Terms; we'll notify you in-app or by email for material changes. Continued use means acceptance.
